1. Use of Website

This website is provided for the purpose of browsing our services, requesting a booking, and contacting our team. You agree to use this website only for lawful purposes and not to:

• Attempt to gain unauthorized access to any part of the site or its systems
• Use automated tools (bots, scrapers) to extract content from the site
• Submit false, misleading, or fraudulent information through any booking or contact form
• Use the site in any way that could damage, disable, or impair its functioning

We reserve the right to suspend or restrict access to the website for anyone who violates these terms.

2. User Photos & Media

As part of our service, we may photograph or video the events we set up, including the styled space and, where present, guests.

• By booking with us, you grant Rottberry permission to use photos and videos taken at your event for marketing purposes, including our website, social media, and promotional materials, unless you notify us in writing before your event that you’d prefer to opt out.
• If you or your guests submit photos to us (for inspiration, intake forms, or after your event), you confirm you have the right to share them and grant us permission to view and reference them for planning purposes.
• We will never sell client photos to third parties.
• If you’d like any identifying details (names, locations) withheld from public use, let us know and we will honor that request.

3. Intellectual Property Rights

All content on this website — including our logo, branding, photography, graphic designs, and written content — is the property of Rottberry and is protected by copyright and trademark law.

• You may not reproduce, distribute, or use our content (including event photos we’ve taken) for commercial purposes without our written permission.
• Any custom design concepts, mood boards, or layouts we create for your event remain our intellectual property, even if not used in your final event, and may not be reproduced or resold.

4. Client Responsibility

To ensure a smooth event, clients agree to:

• Provide accurate event details (location, timing, guest count, access information) during booking and intake
• Obtain any necessary permits or permissions for the chosen event location, including venue approval for setup/breakdown if required
• Ensure safe and reasonable access to the event location for our team and vehicles
• Disclose any allergies, dietary restrictions, or site hazards we should be aware of in advance
• Supervise children and guests around decor elements (candles, structures, breakable items) during the event
• Report any damage, missing items, or concerns within 24 hours of the event

Clients are financially responsible for any damage to rented decor or equipment caused by guests, pets, or venue conditions beyond normal wear and use.

5. Disclaimer

• Rottberry makes every effort to style and set up each event as described and agreed upon, but we do not guarantee an exact replication of inspiration photos or mood boards, as natural materials (florals, greenery) and venue conditions vary.
• We are not responsible for delays, damages, or event disruptions caused by circumstances beyond our reasonable control, including weather, venue restrictions, third-party vendor delays.
• We are not liable for any pre-existing property damage at the event location, nor for incidents arising from guest behavior during the event.
• Our liability for any claim related to our services is limited to the amount paid for the booking in question.

6. Payment Terms

• Full payment is due at the time of booking to confirm your date.
• We accept all major credit and debit cards, as well as Klarna.
• Prices are subject to change, but any price agreed upon at the time of booking will be honored for that event.

7. Cancellation & Rescheduling

• Free cancellation is available within 24 hours of booking.
• After the 24-hour window, clients may reschedule once at no additional cost.
• If a rescheduled date does not work and the client wishes to cancel entirely, a 70% refund of the purchase price will be issued.

8. Limitation of Liability

To the fullest extent permitted by law, Rottberry, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to loss of enjoyment, emotional distress, or guest injury not caused by our direct negligence.

9. Indemnification

You agree to indemnify and hold harmless Rottberry from any claims, damages, or expenses (including legal fees) arising from your breach of these terms, misuse of our services, or your own negligence during the event.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of Maricopa County, Arizona.

11. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
